LeCafé

User Agreement

Last updated: 9 October 2026

This is a draft and will be finalised after legal review. The company's registered name, address and contact details will be added here once incorporation is complete.

1. Parties, definitions and subject

This agreement is between you, as a renter using the LeCafé platform, and LeCafé, which operates it. Our registered name, address and contact details will be added to this clause once incorporation is complete.

LeCafé is a platform for renting computers owned by partner Providers by the periods the Provider offers (hour, day, week, month), and using them remotely. The subject of this agreement is the terms on which that service is provided.

LeCafé does NOT own or operate the machine you rent. The machine, the premises, the power and the internet connection are provided by the Provider. LeCafé handles matching, connectivity, billing and collection.

2. Formation and term

This agreement is formed electronically the moment you read the text in the app and press "I have read and accept". You cannot use the service without accepting.

Your acceptance is recorded together with its timestamp, the version of the text and the text's integrity digest (sha256). That record is the proof of which text you accepted, and we will provide it to you on request.

The agreement runs indefinitely and ends in the cases set out in clause 16.

3. Pre-contractual information

This clause contains what you need to know before the agreement is formed, as required by distance-selling legislation.

4. Account, age and identity

Accounts are created with Google sign-in only and are personal to you. You may not let anyone else use your account, nor transfer or sell it.

You must be 18 or older to use the service. By accepting, you declare that you meet this requirement.

You must verify your phone number by SMS before you can use your account. A verified number can be linked to only one account at a time.

You are responsible for keeping your details accurate and up to date. Account security is also yours: protecting the device you sign in from and your Google account is your obligation.

An account can be signed in on one device at a time. Signing in elsewhere closes the previous session.

Everything done under your account counts as done by you. If you let someone else use your account, you are responsible for their actions as if they were your own.

5. Balance, charging and no refunds

Rentals are prepaid: you load a balance first, and it is drawn down during the rental.

Rentals are by period (hourly, daily, weekly or monthly) and the price of the period is charged IN ADVANCE AT THE START OF THE PERIOD: the first period when the connection is established and the rental starts, and each later period when the previous one runs out. The machine is assigned to you for the whole period — whether or not you actually use it, and whether or not you are at your screen or connected to the machine. Period lengths are fixed: an hour is 60 minutes, a day 24 hours, a week 7 days and a month 30 days.

When you start a rental you choose whether it renews at the end of the period. With renewal on, the rental RENEWS AUTOMATICALLY at the end of each period and the price of the new period is deducted from your balance. You do NOT need to have the app open or be connected to the machine for that. You can turn renewal off and on in the app at any time while the rental runs. With renewal off, the rental runs to the end of the paid period and does not renew. If, at renewal, your balance does not cover the new period, the rental does not renew and closes at the end of the paid period.

If, at renewal, the machine cannot be reached or no session is open on the machine, renewal is held briefly (about 90 seconds, ten minutes at most). If the situation clears within that time, the rental renews FROM THE MOMENT THE PAID PERIOD ENDED. The time spent waiting counts towards the new period and every period that has run out is charged. If your balance does not cover all the periods that have run out, none of them is charged. If the situation does not clear, or the balance is insufficient, the rental does not renew and closes at the end of the paid period.

If YOU end a rental before the period runs out, the remainder of the paid period is not given back. If the Provider or LeCafé ends the rental before the period runs out, the amount corresponding to the unused time is CREDITED BACK TO YOUR BALANCE. A credit is not a refund. It is made as balance.

NO automatic credit is made in the following cases: the rental was ended because of your breach of this agreement. The machine cannot be reached during the period or no session remains open on it (the rental stays open until the end of the period and the time you could not use is not credited). The LeCafé software on the machine is removed while the rental is running. The rental closes because the connection between your device and the machine cannot be established directly. In these cases, if the loss was not caused by you, you can apply through the support screen. Your request is reviewed and, if found justified, the amount is credited to your balance.

Balance is denominated in Turkish Lira, bears no interest, cannot be converted to cash and cannot be transferred to another account. Balance does NOT expire. It stays usable for as long as your account is open.

NO REFUNDS ARE MADE. Neither the balance you load nor the time spent in a rental is refunded on any ground, and balance cannot be converted to cash.

The legal basis is this: the service is supplied electronically and immediately, and its performance begins the moment you start a rental. Distance-selling legislation excludes services supplied instantly in the electronic environment, and services whose performance has begun with the consumer's consent, from the right of withdrawal. By accepting, you request that performance begin immediately and acknowledge that no right of withdrawal exists for these services.

Your card details never reach LeCafé at any stage. Collection takes place on the payment institution's own secure page.

Prices may change. A change applies only to rentals started AFTER it takes effect. The period rate of a rental already under way stays fixed for its duration, renewed periods included.

Unjustified chargebacks are prohibited. If you raise an unjustified objection to a top-up you made, your account will be closed, your balance will become unusable, and the resulting loss and costs will be claimed from you.

6. Interruptions caused by LeCafé

If a rental is cut short by a fault on our side, the amount corresponding to the interrupted period is CREDITED BACK TO YOUR BALANCE. This is not a refund. Compensation is made as balance and clause 5 applies to it in full.

Interruptions originating from the Provider, the Provider's internet or power infrastructure, your own device or your own internet connection are not covered by this clause.

7. Rentals and sessions

You can rent more than one machine at a time. Each rental is charged separately and all of them are billed to the same balance. A rental you are not connected to at the moment keeps running and, with renewal on, renews. Every rental runs to the end of the paid period and is subject to the renewal rule in clause 5.

You can start a new rental once your previous rental has connected to its machine and started: only one of your rentals can be waiting to connect at a time.

A machine has only one renter at a time. A guest you invite into your rental (clause 8) is not an exception — that is not a separate rental but participation in yours.

A rental ends when you end it, when it is not renewed (renewal is off, or your balance does not cover the new period), or when the Provider or LeCafé ends it.

A rental ends AUTOMATICALLY and immediately in two cases: the connection between your device and the machine cannot be established directly, and the LeCafé software on the machine is removed. The machine being unreachable, or no session remaining open on it, does not close the rental during the period. If that still holds at the end of the period, the renewal rule in clause 5 applies and the rental is not renewed. Your own connection dropping affects neither the rental nor its renewal.

Video, audio and input flow over an encrypted connection established directly between your device and the machine. This traffic does NOT pass through LeCafé servers.

During a rental the machine's physical display outputs are switched off. Your session is not visible on a monitor attached to the machine.

Connection quality depends on your internet access, the Provider's line, your device and the network conditions in between. No particular image quality, latency, frame rate or uninterrupted service is guaranteed. Nor is it guaranteed that a particular game, application or hardware feature will be present on the machine.

8. Guests (second player)

You may invite a guest into your rental as a second player. Guests are not charged separately. The rental is billed to your balance only.

You may invite one guest into each rental. If you have more than one rental, you may invite the same person into all of them. Being a guest in someone else's rental does not prevent you from starting your own, and you can be a guest in more than one rental at a time.

A guest joins with an account that has also accepted this agreement and verified a phone number.

You are responsible for everything your guest does during the rental AS IF IT WERE YOUR OWN ACT. A breach of this agreement by your guest counts as your breach.

9. Prohibited uses

You may not use the machine you rent for any unlawful purpose. The following are prohibited in all cases:

You are responsible for the content you create and everything you do on the machine you rent.

10. Consequences of a breach

In the event of a breach of this agreement, the following measures may be applied individually or together, according to the seriousness of the breach:

You are directly liable for damage you cause to the machine's hardware or software intentionally or through gross negligence.

11. Indemnity and recourse

If a third-party claim is brought against LeCafé or the Provider, or an administrative sanction is imposed, because of conduct by you that breaches this agreement or the law, all resulting loss — including compensation paid, administrative fines, legal fees and litigation costs — is recovered from you.

12. Data you leave in a session

After a rental ends, the machine is cleaned up for the next user. Files you leave on the machine are NOT guaranteed to be preserved. They may be deleted.

Removing your personal files, signing out of sessions you opened and clearing your passwords before the rental ends is your responsibility. LeCafé is not liable for loss arising from account details you leave stored on the machine.

13. Records, audit and support access

The following records are kept for the operation and security of the service and to meet our legal obligations:

Your video and audio during a rental are NOT recorded, no screenshots are taken, and what you type or which applications you open are not monitored or stored.

Details of how your personal data is processed are in the Privacy Policy.

14. Continuity and force majeure

A machine may be withdrawn from rental because of the Provider's decision, maintenance, a fault, or a power or internet outage. The platform as a whole may also be paused temporarily for maintenance.

In circumstances beyond our reasonable control — natural disaster, fire, epidemic, war, cyber attack, legislative change, outages at infrastructure providers — performance of obligations is suspended for as long as those circumstances last.

15. Limitation of liability

To the extent permitted by applicable law, LeCafé is not liable for disruptions arising from the performance of the hardware provided by the Provider, the Provider's internet and power infrastructure, or your own device and internet connection.

To the extent permitted by applicable law, LeCafé is not liable for indirect losses such as loss of profit, loss of data or business interruption.

The limitations in this clause do NOT cover liability arising from LeCafé's intent or gross negligence, nor any liability that the law does not permit to be limited.

16. Suspension, termination and account closure

In the event of a breach of this agreement, a payment dispute or suspected abuse, your account may be suspended temporarily, or the agreement terminated and your account closed.

You may ask to close your account at any time. When the account is closed, any remaining balance becomes unusable and is not refunded, in accordance with clause 5.

Termination does not extinguish obligations and liabilities that arose before it. Financial records and access records are retained for the periods required by law.

17. Changes and re-acceptance

This agreement may be updated. The text carries a version number, and the current version is always available on this screen in the app.

When an update changes the meaning of the text, the version number increases and you are asked to accept the new text before you can continue using the service. If you do not accept, you can still close an active rental and contact support to close your account.

18. Agreement on evidence

In disputes arising from this agreement, LeCafé's system records, event logs, rental and payment records, access records and agreement acceptance records constitute CONCLUSIVE EVIDENCE within the meaning of article 193 of the Turkish Code of Civil Procedure (no. 6100).

This clause does not limit any evidentiary rights you have under consumer legislation where you act as a consumer.

19. Assignment, severability and notices

You may not assign your rights and obligations under this agreement to third parties. LeCafé may transfer the agreement to an acquirer in the event of a transfer of the business.

If a provision of this agreement is held invalid or unenforceable, the validity of the remaining provisions is unaffected. The invalid provision is deemed replaced by the valid provision closest to its purpose.

Notices are given to the e-mail address linked to your account and by in-app notification. Keeping that address current is your responsibility.

20. Governing law and dispute resolution

This agreement is governed by the laws of the Republic of Türkiye.

Disputes fall within the jurisdiction of consumer arbitration committees and consumer courts, according to the applicable monetary thresholds.

Your mandatory rights under consumer legislation are reserved. No provision of this agreement may be construed so as to remove or limit rights granted to you by mandatory law.

21. Contact

You can raise questions, requests and complaints through the support screen in the app.

Our registered name, full address and other contact details will be added to this clause once incorporation is complete.
